In U.S. regulation, the formal RUO statement comes from the FDA's labeling rule for in vitro diagnostic products, 21 CFR 809.10(c)(2). A product in the laboratory research phase must carry the statement "For Research Use Only. Not for use in diagnostic procedures."

Why the label alone doesn't decide anything
FDA's 2013 guidance on RUO and IUO products (Distribution of In Vitro Diagnostic Products Labeled for Research Use Only or Investigational Use Only) says a product's intended use is the "objective intent" of whoever is responsible for labeling it. That intent can be shown by the totality of circumstances around how the product is distributed. In plain terms, the agency can look past the label to how a product is advertised and sold.
The guidance is written for diagnostic products, but the principle is the useful part for any buyer. A seller whose marketing contradicts its own RUO label is a seller whose other claims deserve less trust.
